El artículo plantea si el concebido y no nacido es persona en sentido jurídico o se encuentra desprotegido en el ordenamiento jurídico español, preguntando qué estatuto jurídico tiene: si es persona (cualidad ontológica previa a la determinación del derecho que éste reconoce) y si es sujeto de derechos. Se concluye que en el ordenamiento español la personalidad jurídica se obtiene con el nacimiento, pero también se otorgan al nasciturus una serie de derechos.
The paper raises whether the conceived and not born is a person in a legal sense or is unprotected in the Spanish legal system, asking which is the legal status that nasciturushas: if he is a person (ontological quality prior to the determination and recognition of the right) and if he is subject of rights. It is concluded that in the Spanish system the legal personality is obtained with the birth, but a series of rights are also granted to nasciturus.
