La vida humana está repleta de conflictos. A diario surgen todo tipo de controversias que las personas resuelven por sí mismas.
Sin embargo, existen situaciones que son de difícil solución y por eso, se requiere la intervención de terceros, generalmente, se acude a jueces y tribunales. Esta hiperjudicialización de la vida diaria está provocando que algunas soluciones no se adapten a las necesidades reales de las partes y que el conflicto no resuelto se encone y cronifique hasta provocar un escalamiento y agravación del mismo. Cada vez surgen más voces que proponen el recurso a métodos adecuados de resolución de discrepancias en materia civil y mercantil y a la justicia restaurativa en materia penal. Sin embargo, hay una forma de luchar contra la judicialización de nuestra vida y es con la educación. La formación de los menores debe orientarse a la provención y a la prevención de los conflictos, como inversión necesaria para reducir, a futuro, la actual hiperlitigiosidad en España. Una forma efectiva de educar es acudiendo la filosofía restaurativa acuyos ejes centrales son la responsabilización y la reparación para conseguir la paz social.
Human life is full of conflicts. Every day all kinds of controversies arise that people resolve on their own. However, there are situations that are difficult to solve and therefore, the intervention of third parties is required, generally, they go to judges and courts. This hyperjudicialization of daily life is causing some solutions to not be adapted to the real needs of the parties and the unresolved conflict to fester and become chronic until it escalates and worsens. More and more voices are emerging that propose the use of appropriate methods of resolving discrepancies in civil and commercial matters and restorative justice in criminal matters. However, there is a way to fight against the judicialization of our lives and that is through education. The training of minors must be oriented towards conflict resolution and prevention, as a necessary investment to reduce, in the future, the current hyper-litigation in Spain. An effective way of educating is using the restorative philosophy whose central axes are responsibility and reparation to achieve social peace
