This article analyses the institutional and social criminalisation of prostitution in the state of Spain from a critical and multidisciplinary perspective. Starting with the concept of stigma and its historical roots, this study examines how the current legal framework - characterised by illegality, and normative dispersion - contributes to generating situations of exclusion, violation of rights, and the vulnerability of women engaged in prostitution. The research combines a bibliographical and regulation review with an explanatory qualitative analysis, supplemented by semi-structuredinterviews with three associations in the Basque Country which work directly with this population group. The results evidence that the enforcement of laws such as the Organic Law for the Protection of Citizen’s Security, the municipal ordinances, the Law of Immigration, and the Comprehensive Guarantee of Sexual Freedom Law have had adverse effects on the daily lives of sex workers, reinforcing precariousness, clandestinity, and stigma. It is concluded that the criminalizationof prostitution, without offering protection, acts as a mechanism of social control that deepens structural inequalities and limits effective access to fundamental right.
