As primeiras ordenações jurídicas sobre o meio ambiente brasileiro foram importadas de Portugal com a chegada dos europeus. Desse período até o presente ano, a legislação sobre o meio ambiente apresentou avanços e retrocessos que estão relacionados com a conjuntura histórica pelo qual o Brasil atravessava e sua relação com o contexto internacional. A legislação ambiental é a forma como a nação disciplina a relação entre a sociedade e o meio ambiente em que se insere. Esse artigo visa analisar a evolução histórica da legislação ambiental no Brasil. Para tal, foi realizada uma pesquisa qualitativa baseada em levantamento bibliográfico e exame das normas ambientais. Espera-se que este estudo possa auxiliar pesquisadores e demais interessados em compreender como a sociedade brasileira abordava o meio ambiente em seus períodos históricos e em entender o caminho que o direito ambiental percorreu até o presente.
The first legal regulations about the Brazilian environment were imported from Portugal with the arrival of Europeans. From this period until today, the environmental laws had its advances and setbacks, which are related to the historical context that Brazil was going through and its relationship with the international context. Environmental legislation is how the nation disciplines the relationship between society and its environment. This article aims to analyze the historical evolution of environmental legislation in Brazil. We carried out qualitative research based on a bibliographical survey and examination of environmental norms. We hope that this study can assist researchers and others interested in understanding how Brazilian society approached the environment in its historical periods and to understand the path that environmental law has taken until the present moment.
