OBJECTIVE: establish whether the parameters provided for in the article 11 Bis of the Criminal Procedure Code are objective and sufficient, in order to qualify the existence of due justification. METHOD: this research will be focused on as a legal-constitutional problem which, in addition to the interpretative-constitutional methods, will include factual and axiological elements. RESULTS: the multifaceted legal and functional foundations underpinning criminal sentencing, examining statutory and constitutional frameworks; the factors influencing judicial decisions; the role of guidelines and discretion; and the broader societal implications of sentencing policies; ultimately, all of these contribute to a comprehensive understanding of what constitutes a fair and effective basis for criminal sentencing. CONCLUSION: the central point of the article is to determine whether due substantiation, which must be clear and precise, is completely clear when qualifying what is or is not a due substantiation in the rulings that resolve matters in criminal matters or if the qualification of such circumstance takes into account the subjectivity or particularity of the case in which such requirement is being verified.
