Resumen de La Justicia Terapéutica como marco integrador en el abordaje psicológico de adolescentes en conflicto con la ley

  La Justicia Terapéutica (JT) representa un enfoque innovador que concibe al Derecho como una herramienta potencialmente transformadora, especialmente en el trabajo con adolescentes que han incurrido en conflictos legales. En este sentido, resulta fundamental articular los dispositivos legales con intervenciones psicológicas que prioricen la subjetividad y el bienestar psíquico del joven, en lugar de enfocarse únicamente en la sanción. La JT permite integrar saberes jurídicos, psicológicos y sociales, favoreciendo un abordaje más humano, preventivo y eficaz. En el caso de los adolescentes infractores, este modelo ofrece la posibilidad de comprender sus conductas a partir de su estructura psíquica, historia vital y contexto sociocultural, facilitando estrategias de tratamiento que consideren sus recursos emocionales y sus capacidades de cambio. Así, la JT no sólo busca una resolución jurídica, sino que promueve una justicia que repare, escuche y habilite procesos de elaboración subjetiva y reinserción social.

  Therapeutic Justice (TJ) represents an innovative approach that views Law as a potentially transformative tool, particularly in work with adolescents involved in legal conflicts. In this regard, it is essential to integrate legal mechanisms with psychological interventions that prioritize the youth’s subjectivity and psychological well-being, rather than focusing solely on punishment. TJ enables the integration of legal, psychological, and social knowledge, fostering a more humane, preventive, and effective approach. For adolescent offenders, this model provides the opportunity to understand their behavior based on their psychic structure, life history, and socio-cultural context, facilitating treatment strategies that consider their emotional resources and capacity for change. Thus, TJ not only seeks legal resolution but also promotes a form of justice that repairs, listens, and enables processes of subjective elaboration and social reintegration.
