PROBLEM: the presumption of innocence consists in guaranteeing the innocent treatment of the subject of criminal proceedings. This guarantee is undermined by depriving the accused of his or her liberty, by means of preventive detention, by applying a measure which often anticipates the effects of the penalty, and violates fundamental guarantees by abusing the excessive use and lack of judicial motivation of the same. OBJECTIVE: to analyze the principle of the presumption of innocence and its application in the Guatemalan criminal system. METHOD: analytical, deductive and scientific. RESULTS: the State of Guatemala violates the guarantees of the accused by granting preventive detention measures indefinitely, without reliably guaranteeing the reason for which it considers it strictly necessary to deprive a person who enjoys the presumption of innocence of his liberty. CONCLUSION: pretrial detention is a precautionary measure intended to guarantee the presence of the accused in criminal proceedings, through the restriction of liberty, that is why the judicial decision ordering the same, must comply with all minimum guarantees, including a correct argument including a correct argument as to why the liberty of a person deemed innocent is restricted
